WAME Terms of Service
Effective Date: May 14, 2026
Article 1 Purpose
These Terms of Service govern the rights, obligations, and responsibilities between BlackWho's Co., Ltd. (hereinafter "Company") and users concerning the use of the WAME platform (hereinafter "Service") operated by the Company.
Article 2 Definitions
① Service: An online platform provided by the Company, including game information introduction, content posting, community activities, personalized recommendations, creator-game company matching, and related functions.
② Member: A person who agrees to these Terms, creates an account, and uses the Service. Members are classified as follows:
- General Member: A person who browses game information, consumes content, and uses personalized recommendation services.
- Creator Member: A person who registers their own created content on the Service and may receive campaign proposals from game companies.
- Game Company Member: A game developer or publisher who registers game information, commissions content creation from creators, and may subscribe to paid services such as the insight dashboard.
③ Content: All materials posted by members on the Service, including reviews, posts, comments, images, video links, tag information, etc.
④ Creator Content: Game-related videos, reviews, walkthroughs, streams, and other creations registered by Creator Members.
⑤ Game Content: Game information, promotional materials, campaign briefs, etc. provided by Game Company Members.
⑥ Insight Data: Anonymized information generated through statistical analysis of members' service usage behavior, content consumption patterns, persona matching results, etc.
Article 3 Role of the Platform
① The Company provides a platform for introducing game information, exchanging opinions among users, and matching between creators and game companies.
② The Company is not directly involved in the development, operation, or provision of individual games and bears no responsibility for such game services.
③ The Company is not a party to the contract between Creator Members and Game Company Members and only performs the role of an intermediary platform. The formation, performance, and disputes of such contracts shall be resolved between the parties in principle.
Article 4 Effect and Amendment of the Terms
① These Terms shall take effect upon being posted within the Service.
② The Company may amend these Terms to the extent that it does not violate applicable laws and regulations.
③ When the Terms are amended, the Company shall announce the amendment at least 7 days before the effective date. However, for changes unfavorable to members, at least 30 days' notice shall be provided.
④ Members who do not agree to the amended terms may terminate the service agreement, and if no intention to terminate is expressed by the effective date of the amended terms, the member shall be deemed to have agreed to the amended terms.
Article 5 Membership Registration
① General Member registration is completed when the user agrees to these Terms and the Privacy Policy and the Company approves the registration.
② Creator Members acquire their status through a separate application process after registering as a General Member. The Company may grant or deny Creator Member status in consideration of content quality, suitability, etc.
③ Game Company Members register through a separate application process, and the Company approves after verifying the applicant's qualifications as a game developer or publisher.
④ The Company may restrict registration in the following cases:
- Identity theft using another person's information.
- Input of false information.
- Registration for the purpose of disrupting the Service's operation.
- History of violating the Terms.
Article 6 Account Management
① Members are responsible for safely managing their account information.
② The Company shall not be liable for damages caused by unauthorized use of an account, unless such damages result from the Company's willful misconduct or gross negligence.
③ Members must immediately notify the Company upon becoming aware that their account has been stolen or is being used without authorization by a third party.
Article 7 Service Provision
① The Company shall endeavor to provide the Service 24 hours a day, year-round. However, the Service may be temporarily suspended in the following cases:
- System maintenance.
- Technical failures.
- Force majeure.
② The Company may change or terminate all or part of the Service, and in such cases, shall provide prior notice. However, in cases of urgent necessity, the Company may provide notice afterwards.
Article 8 Content Posting and Utilization
① Copyright of content posted by members belongs to the respective member.
② Members grant the Company the right to utilize content within the following purposes for the operation of the Service and provision of its functions:
- Storage, reproduction, disclosure, and transmission within the Service.
- AI-based content analysis and tagging (style, genre, target user level, information density, etc.).
- Matching with user personas and personalized recommendations.
- Creation of anonymized statistical data and provision to the Game Company Member insight dashboard.
- Service operation and promotion.
③ The Company may store content in a vector database and utilize it through RAG (Retrieval-Augmented Generation) methods for the purposes described in paragraph (2).
④ The Company shall not artificially transform, distort, or recreate members' content using AI, and shall use it solely for analysis and matching purposes. "Editing" is limited to adjustments in display format (thumbnail generation, preview, etc.) within the Service.
Article 9 Personalized Services and Profiling
① The Company may collect and analyze the following data to provide members with optimized game and content recommendations:
- Behavioral data such as searches, clicks, viewing, saving, and sharing within the Service.
- Preferred genres, game styles, and preference information directly entered by members.
- Game library and play history within the scope explicitly consented to by members when linking accounts from third-party platforms (Steam, PlayStation Network, Xbox Live, etc.).
② Based on the data described in paragraph (1), the Company automatically generates a game preference persona for members and recommends personalized content and games.
③ Members may refuse personalized recommendations or unlink third-party platform accounts at any time in their account settings. However, even upon refusal of recommendations, general use of the Service remains available.
④ Where automated decision-making (profiling) significantly affects a member, the Company shall provide an explanation of the decision upon the member's request.
Article 10 Prohibited Activities
Members shall not engage in the following activities:
- Using another person's account.
- Posting illegal content.
- Writing false reviews or false tags.
- Disrupting the Service.
- Distributing malicious code.
- Infringing copyright.
- Defaming others.
- Manipulative activities using automated programs.
- Unauthorized collection, processing, or resale of insight data.
Article 11 Content Management
① The Company may delete or hide the following content without prior notice:
- Illegal content.
- Defamatory content.
- Copyright infringing content.
- Content harmful to minors.
- Content disrupting the Service's operation.
- Content falling under the prohibited activities in Article 10.
② Members may raise objections to the Company if they believe their content has been deleted unjustly.
Article 12 Advertising and Campaign Content
① The Service may include advertising content and campaign content commissioned by Game Company Members.
② The Company shall clearly indicate advertising and campaign content so that users can recognize it.
③ The indication in paragraph (2) shall also apply to campaign content produced by Creator Members upon commission by Game Company Members.
④ The Company shall not be liable for transactions between members and advertisers (including Game Company Members), unless such liability arises from the Company's willful misconduct or gross negligence.
Article 13 Changes to and Termination of the Service
① The Company may change or terminate all or part of the Service.
② When terminating the Service, the Company shall provide notice at least 30 days before the termination date and inform members of backup methods for the content and data they have registered.
Article 14 Restrictions on Use
① If a member violates the Terms, the following measures may be taken, either progressively or concurrently:
- Warning.
- Deletion or hiding of posts.
- Restriction of use of certain functions.
- Account suspension (temporary or permanent).
- Termination of the service agreement.
② The Company may provide members with an opportunity to explain themselves before taking the measures in paragraph (1). However, in cases of urgent violations, the Company may take action first and notify afterwards.
Article 15 Revenue Generation and Paid Services
① The Company may provide paid services such as insight dashboards, persona analysis, and GEO monitoring to Game Company Members. Fee schedules and charging methods shall be separately announced on a page within the Service.
② The Company may receive fees or commissions in accordance with methods separately determined by the Company for completed contracts between Creator Members and Game Company Members or for transactions occurring within the Service. Specific commission rates, charging methods, payment conditions, etc. shall be separately announced within the Service, and members shall confirm and agree to such details before proceeding with transactions.
③ The Company may change commission rates and fee schedules, and shall announce such changes within the Service at least 14 days before the effective date. Members who do not agree to the changes may discontinue use of the relevant paid services or terminate the service agreement.
④ The Company shall separately establish and post within the Service a policy regarding the cancellation of paid services and refunds.
Article 16 Limitations and Disclaimer for Insight Data
① The insight dashboard, recommendation systems, AI analysis results, etc. within the Service are estimates based on statistical methodologies, and the Company does not guarantee the following:
- Specific marketing performance or revenue increase.
- Specific rankings or share in external AI search results.
- Actual user purchases or conversion behavior.
- Complete accuracy or error-free nature of data.
② Game Company Members understand that insight data is reference material based on "observed correlations" and shall use it only as a supplementary resource for business decision-making.
③ The Company provides no express or implied warranty regarding the accuracy, reliability, or completeness of insight data, and shall not be liable for damages resulting from business decisions based entirely on insight data, unless such damages arise from the Company's willful misconduct or gross negligence.
Article 17 Disputes Between Creators and Game Companies
① Disputes between Creator Members and Game Company Members concerning contract terms, content quality, payment, etc. shall be resolved through direct negotiation between the parties in principle.
② Although the Company, as an intermediary platform, is not the principal party in dispute resolution, it may cooperate within a reasonable scope, such as providing intermediary information in its possession, to facilitate resolution.
③ The Company bears no responsibility for disputes arising from the fault of Creator Members or Game Company Members.
Article 18 Disclaimer
① The Company shall not be liable in the following cases:
- Service disruptions due to force majeure (natural disasters, war, terrorism, epidemics, government regulations, etc.).
- Damages attributable to the user.
- Damages caused by problems with third-party services (Steam, PSN, AI platforms, etc.).
- Disputes between members or between members and third parties within the Service.
② Unless resulting from the Company's willful misconduct or gross negligence, the Company shall not be liable for damages arising from the use of the Service.
③ With respect to services provided free of charge, the Company shall not be liable for damages unless such damages arise from the Company's willful misconduct or gross negligence.
Article 19 Personal Information
① The Company collects, uses, and protects members' personal information in accordance with the Privacy Policy.
② The Company separately posts the Privacy Policy within the Service so that members can review it at any time.
Article 20 Governing Law and Jurisdiction
① These Terms shall be governed by the laws of the Republic of Korea.
② In the event of a dispute arising in connection with the use of the Service, the Company and the member shall negotiate in good faith to resolve the dispute.
③ If no agreement is reached through negotiation, the court with jurisdiction under the Civil Procedure Act shall be the exclusive court of jurisdiction.
[Addendum] These Terms shall be effective from May 14, 2026.
